On Thursday, November 4, 2021, the Occupational Safety and Health Administration (OSHA) published an Emergency Temporary Standard (ETS) that establishes minimum COVID-19 vaccination and testing requirements for private employers with 100 or more employees throughout the United States.
Shortly after the ETS was published, several states and businesses sued to declare that the rule was unconstitutional and beyond OSHA‘s statutory authority. On November 6, 2021 the Fifth Circuit Court of Appeals (based in New Orleans) issued a very short preliminary ruling “staying” implementation of the ETS pending further briefing in the court. Then, on November 12, 2021 the Fifth Circuit entered a long opinion in which it has issued a preliminary stay of the law.
In doing so, the court signaled in the strongest of possible terms that it was poised to find that the rule does exceed OSHA‘s statutory authority in several ways and is unconstitutional.
In recognition of the court‘s ruling, the administration declared that OSHA has suspended all activities relating to the implementation and enforcement of the ETS pending further litigation. However, this is still a temporary ruling and will be appealed, most likely all the way to the Supreme Court, which would make the final decision.
Although not expressly stated, this means that employers under the rule have a reprieve of the upcoming December 5, 2021 deadline, and likely the January 4, 2022 deadline as well, as the courts will take some time to provide much-needed clarity and a final decision.
This week, the Florida legislature is meeting in a special session in an effort to consider legislation that would countermand at least parts of the OSHA rule.
Businesses should stay tuned to see what, if any legislation, is passed by the Florida legislature, how the courts will ultimately decide on the fate of the OSHA rule, and how these two will play out if the courts determine that the OSHA rule is valid.
This court decision has no effect on vaccine mandates applying in healthcare settings or to federal contractors and subcontractors.

Filed in the northern district of California, the Ohio suit claims that chief executive Mark Zuckerberg and associates violated federal securities law by knowingly deceiving the public.“Facebook said it was looking out for our children and weeding out online trolls, but in reality was creating misery and divisiveness for profit,” Yost said.“We are not people to Mark Zuckerberg, we are the product and we are being used against each other out of greed.”The litigation comes amid a larger backlash against Zuckerberg and his online empire, after Haugen shared what the suit calls “a trove of internal company documents” showing Facebook’s complicity in the harm its platforms cause. Through Wall Street Journal articles and other reportage, Haugen’s leaks uncovered how little Facebook’s leadership was doing to protect users or even abide by its own rules. The revelations have further eroded trust in the social media behemoth and caused financial repercussions. Between 13 September and 21 October – as the Wall Street Journal published its exposés – “Facebook’s stock price declined by $54.08 a share, or over 14%”, the Ohio lawsuit states. Yost filed the complaint on behalf of Facebook investors and the Ohio Public Employees Retirement System, a public pension fund affected by falls in Facebook shares. The suit relies on Haugen’s evidence to assert that Facebook knew its platforms “facilitate dissension, illegal activity and violent extremism, and cause significant harm to users, especially children” but refused to meaningfully course-correct.“This matter arises from an egregious breach of public trust by Facebook, which knowingly exploited its most vulnerable users – including children throughout the world – in order to drive corporate profits,” the complaint says. A Facebook spokesperson said the lawsuit was “without merit” and said the company would fight it. The Associated Press contributed reporting.

Ghaleb Alaumary, a 36-year-old dual U.S and Canadian citizen, worked for cyber criminals including the three North Koreans who heisted as much 1.3 billion dollars in a cybercrime spree believed to be executed on behalf of North Korean intelligence.Among the victims of the spree was a major Maltese bank, the Bank of Valletta, which was robbed of $14 million in 2019. To turn that cash into usable currency, the hackers turned to Alaumary.
“Alaumary recruited and organized individuals to withdraw stolen cash from ATMs; he provided bank accounts that received funds from bank cyber-heists and fraud schemes; and, once the ill-gotten funds were in accounts he controlled, Alaumary further laundered the funds through wire transfers, cash withdrawals, and by exchanging the funds for cryptocurrency,” the DOJ explained.
The North Korean spree employed other high-profile money launderers, including the Nigerian social media influencer Ramon “Hushpuppi” Abbas.
Before working with the North Koreans, Alaumary was implicated as an accomplice in the theft of $9.4 million from Canada’s McEwan University.
According to the DOJ, Alaumary worked with others to convince the university that they represented a construction company who had been involved in a major building project at the school, ultimately defrauding the school into wiring the team millions.
In addition to the jail time, Alaumary has also been ordered to pay more than $30 million to his victims in restitution.
“Other victims of Alaumary’s crimes included banks headquartered in India, Pakistan and Malta, as well as companies in the United States and U.K., individuals in the United States and a professional soccer club in the U.K.,” the DOJ said.

President Joe Biden had suspended former President Donald Trump’s “Remain in Mexico” policy on his first day in office and the Department of Homeland Security said it was permanently terminating the program in June, according to the court record. U.S. District Judge Matthew J. Kacsmaryk last week ordered that the program be reinstated Saturday.
The Biden administration appealed to the 5th U.S. Circuit Appeal in New Orleans and asked for a delay in re-implementing the program, formally known as Migrant Protection Protocols, pending appeal. The administration argued in briefs that the president has “clear authority to determine immigration policy” and that the Secretary of the Department of Homeland security, Alejandro Mayorkas, had discretion in deciding whether to return asylum seekers to Mexico.
Lawyers for the states of Texas said Missouri, which challenged the suspension of MPP, opposed a stay of Kacsmaryk’s order. They said the Biden administration had not gone through proper procedures in ending the policy. And they argued that after the policy was implemented immigrants without legitimate claims for asylum had begun to return to their home countries voluntarily.

On Thursday (Aug. 12), the FBI arrested Anton Joseph “Tony” Lazzaro on multiple sex trafficking charges. According to Minnesota’s Star Tribune, Lazzaro is a local business man who also acts as a Republican strategist. He is reportedly the founder of the Big Tent Republicans PAC. He made his first appearance in court.
The U.S. Attorney’s Office for the district of Minnesota alleges that Lazzaro “conspired with others to recruit and solicit six minor victims to engage in commercial sex acts” between May and December 2020. The feds have charged Lazzaro with one count of conspiracy to commit sex trafficking of minors, five counts of sex trafficking of minors, one count of attempted sex trafficking of a minor, and three counts of obstruction of justice.

Sky News Washington correspondent Annelise Nielsen says there’s going to be some “political pressure” in the lawsuit between Australian resident Virginia Giuffre and Prince Andrew, who’s close to the royal family.

Since the adoption of the new German law, at least 13 countries—in addition to the European Commission—have adopted or proposed models of intermediary liability broadly similar to the act’s matrix. According to Freedom House’s 2019 assessment of freedom on the internet, four of those countries are ranked as being “not free” (Venezuela, Vietnam, Russia and Belarus, Honduras is not surveyed but is ranked as “not free” on press freedom), five are ranked “partly free” (Kenya, India, Singapore, Malaysia, and the Philippines), and only three are ranked “free” (France, the United Kingdom, and Australia). With the exception of India, Kenya, Vietnam, and Australia, all these countries—as well as the European Commission—have explicitly referred to the Network Enforcement Act as an inspiration or justification for their models of intermediary liability.
Moreover, several of these countries, including Venezuela, Vietnam, India, Russia, Malaysia, and Kenya, require intermediaries to remove vague categories of content that include “fake news,” “defamation of religions,” and “anti-government propaganda,” and many of them include overly broad definitions of hate speech that go much further than the German law. A Russian bill signed into law by President Vladimir Putin in March is a good example.

Any controversial opinion or criticism of the government could plausibly be covered by this overly broad and vague definition, which falls considerably short of international human rights standards.
The explanatory report of the Russian bill explicitly referred to the Network Enforcement Act, and, responding to criticism, Kremlin representatives argued that false information “is regulated fairly harshly in many countries of the world including Europe. It is therefore of course necessary to do it in our country too.” This is a clear example of how Germany’s internet law provides cover for authoritarian states attempting to restrict online content.

In May, Singapore adopted the wide-ranging Protection from Online Falsehoods and Manipulation Bill. The law includes a vague definition of “false statements of fact,” authorizing a minister to issue directions to internet intermediaries that must correct or disable content. Prior to the adoption of the bill, a preliminary report referenced the German law. What might constitute false statement of facts? A 2018 report by the policy forum of Singapore’s ruling People’s Action Party highlighted a Human Rights Watch report critical of press freedom restrictions in Singapore as based on “deliberate falsehoods” used to “advocate political change.” In other words, the law may well be used to target human rights and civil society groups shining a critical light on the Singaporean government.
However, both the Russian and Singaporean laws pale in comparison to the sweeping category of illegal content covered by Vietnam’s draconian Law on Cybersecurity, which passed in 2018 and prohibits: “propaganda against the Socialist Republic of Vietnam,” “distortion or defamation of the people’s administrative authorities,” “psychological warfare … causing division or hatred between [Vietnamese] ethnic groups, religions and people of all countries,” “insulting the [Vietnamese] people, the national flag, national emblem, national anthem, great men, leaders, famous people or national heroes,” and “invented or untruthful contents causing confusion amongst the Citizens.”

It is also problematic that some states, including Russia and Vietnam, have established (or proposed to establish) governmental entities responsible for notifying and ordering intermediaries to remove illegal content without any independent review or complaint mechanisms. When you combine the sweeping nature of the prohibited content with the lack of meaningful oversight, it is clear that these laws will serve to further entrench tight government control over an already restrictive online sphere.
Several of the laws or proposals we identified, including in the U.K. and India, don’t merely rely on a notification and takedown regime. They establish a “duty of care” requiring intermediaries to actively police and preventively remove illegal or undesirable content. Such a step may encourage automated moderation or filtering of user content through artificial intelligence and upload filters. This essentially poses the risk of reintroducing government-mandated prepublication censorship enforced by private tech companies. In the 18th and 19th centuries, European censors lost the struggle to keep up with clandestine publications and increasingly sophisticated printing presses. Consequently, pre-publication censorship all but died in the second half of the 19th century, only to be revamped and revitalized by totalitarianism in the 20th century. But in the digital age, censorship may ultimately be able to search and destroy undesirable content at a scale previously unimaginable.
All these developments suggest that the Network Enforcement Act has provided an important impetus for, and legitimacy to, models of intermediary liability that violate freedom of expression as set out in Article 19 of the International Covenant on Civil and Political Rights. This development contributes significantly to the weakening of the already perilous state of internet freedom around the world.
The adverse consequences of the Network Enforcement Act were certainly not intended by the German government. In conjunction with the German constitution and commitment to the rule of law, the act provides safeguards absent from the most draconian laws subsequently adopted by other states. Indeed, several of the countries that have mimicked the German law had already implemented severe restrictions of online freedom prior to the German initiative and would likely have tightened their grip irrespective of the Network Enforcement Act.
Yet, the act seems to have provided several states with both the justification and the basic model for swift and decisive action. Unwittingly, Europe’s most influential country has contributed to the erosion of global internet freedom by developing and legitimizing a prototype of online censorship that can readily be adapted to serve the ends of authoritarian states.
In a world where both online and offline speech is under systematic global attack, democracies have a special obligation to err on the side of free speech. Succumbing to the ever-present temptation of fighting illiberal ideas with illiberal laws is shortsighted and irresponsible. Once democracies cede the high ground, authoritarians will rush in, creating a regulatory race to the bottom. This entails severe and negative consequences for free speech, independent media, vibrant civil society, and political pluralism, without which authoritarianism cannot be defeated, nor democracy defended.

In einer Welt, in der sowohl die Online- als auch die Offline-Sprache systematisch weltweit angegriffen wird, haben Demokratien eine besondere Verpflichtung, auf der Seite der freien Meinungsäußerung zu irren. Robert Alan Durst (born April 12, 1943) is an American real estate heir and suspected serial killer, the son of New York City businessman Seymour Durst and the elder brother of Douglas Durst, head of the Durst Organization. He is suspected of having murdered three people: Kathleen McCormack Durst, his first wife, who disappeared in New York in 1982; Susan Berman, his longtime friend, who was killed in Los Angeles in 2000; and his neighbor, Morris Black, who was killed in Texas in 2001. Durst was the subject of a multi-state manhunt after Black’s body parts were found floating in Galveston Bay. Although he admitted dismembering Black, he was acquitted of murdering Black on the grounds of self-defense.
On March 14, 2015, Durst was arrested in New Orleans on a first-degree murder warrant in relation to the Berman killing. In 2016 he was transferred to California, and in 2018 a judge ruled there was sufficient evidence for him to be tried for the death of Berman.[1] Durst’s trial began March 2, 2020,[2] but was postponed after six days due to the COVID-19 pandemic.[3] After additional delays the trial resumed May 17, 2021.[4][5]
Also on May 17, 2021, the Westchester County District Attorney said that the disappearance of Kathleen McCormack Durst had been reclassified as a murder and would be reinvestigated.[6][7]

Republican Senator Rand Paul has officially referred Dr Anthony Fauci to the Department of Justice’s Attorney General Merrick Garland in the hope he will launch a criminal investigation into whether the disease expert lied under oath to Congress.
According to the Washington Examiner Senator Paul wrote to the DOJ last week. “I write to urge the United States Department of Justice to open an investigation into testimony made to the United States Senate Committee on Health, Education, Labor, and Pensions by Dr. Anthony Fauci, Director of the National Institute of Allergy and Infectious Diseases, on May 11, 2021,” he wrote.
Last week Dr Fauci was probed by Senator Paul over whether the National Institutes of Health funded dangerous gain-of-function research at Wuhan Institute of Virology. The research is a major theory into how coronavirus originated as it’s the medical procedure of “altering an organism or disease in a way that increases pathogenesis, transmissibility, or host range”.
Dr Fauci strongly denied this and told Congress no funds under his watch went towards the research. However Senator Paul dismissed his denial and said he should be investigated by the DOJ over charges of lying to Congress. “If this virus came from the lab and it becomes clear he was funding dangerous research moral culpability responsibility attaches to him and he does not want that,” Senator Paul told Fox News. Despite Senator Paul’s determination for a criminal investigation, he believes the DOJ will act in a “partisan” way and won’t pursue his recommendation.
The senator said if the public wants the truth they should “convene a panel” of scientists and ask them if President Xi was operating gain-of-function research in China. “Right now Fauci is getting away with this because no one is questioning him,” he said. “He only goes on left wing networks – they give him easy questions like ‘isn’t Rand Paul so out there?’ “That’s the kind of questions he gets. Nobody asks him why it isn’t it gain-of-function research. “And if this science says it’s the epitome of gain-of-function research, how are you still denying it?”

Sky News host James Morrow says Republican Rand Paul “wasn’t having any of Dr Fauci’s attempts to redefine gain-of-function research” as the senator proceeded to “demolish” his claims amid a “pretty testy” exchange this week in US Congress.
Mr Morrow said Senator Paul accused Dr Anthony Fauci, the “liberal left’s secular saint” of the pandemic, of “lying” to cover up his role as head of America’s National Institutes of Health in “funding” coronavirus research at the Wuhan Institute of Virology.
Dr Fauci rejected Senator Paul’s claims on the grounds what was conducted at the labs had been judged by “qualified staff up and down the chain” as not being “gain-of-function” research. Mr Morrow said Senator Paul “demolished” these claims by saying viruses “in nature that only infect animals were manipulated in the Wuhan lab to ‘gain the function’ of infecting humans”.
“We know from Dr Fauci’s own emails that from the very start of the pandemic he was concerned that gain of function research his agency was associated with could have been responsible for the pandemic,” Mr Morrow said. “After the exchange, Senator Paul said he was going to ask the Department of Justice for a criminal referral into Fauci, and whether he lied to Congress.
“It may not be possible to bring back those lives or livelihoods lost to the pandemic, but there may just be some justice for them after all.”

Andrey Pivovarov
On May 31, policemen in St. Petersburg entered onto a plane not long before departure and captured Andrey Pivovarov, the previous chief head of the philanthropic association Open Russia (Otkrytaya Rossiya). Reports immediately surfaced that Pivovarov had been taken to the Investigative Committee for addressing regarding a criminal case concerning crafted by an “unfortunate association.” The BBC Russian Service later revealed that Pivovarov is dealing with criminal indictments over a Facebook post he purportedly distributed in August 2020. Pivovarov’s confinement came four days after Open Russia declared its disintegration trying to shield its activists and allies from criminal arraignment in front of approaching alterations to Russia’s law on “unwanted associations.”
On the evening of May 31, Andrey Pivovarov — the previous chief head of the as of late broke down not-for-profit association Open Russia — was captured in St. Petersburg. Depicting his own capture in a Telegram post, Pivovarov said that it occurred at the Pulkovo Airport: he was set to withdraw for a get-away in Warsaw, when he was removed a LOT Polish Airlines trip without a second to spare. Cops halted the flight of the plane, which was at that point on the runway and planning for departure. “The plane was halted while maneuvering, that is, the point at which the plane was going to take off […] a gathering of cops and FSB officials went ahead load up, after which they revealed to me that I’m needed,” Pivovarov told the radio broadcast Ekho Moskvy. Citing the order to initiate proceedings, the BBC Russian Service reported that the decision to open a criminal case against Pivovarov was based on a Facebook post he allegedly published while in Krasnodar on August 12, 2020. According to the Russian BBC, state investigators describe the Facebook post as “United Democrats informational material” and claim that it concerned a fundraising campaign. The investigators therefore concluded that in writing this post, Pivovarov expressed his intent to participate in the activities of the “undesirable organization” Open Russia. That said, as noted by the Russian BBC, Pivovarov’s Facebook page doesn’t include any posts dated August 12, 2020 that fit this description. However, it’s possible that the investigation was actually referring to a Facebook post by district councilman Alexander Korovainy, which Pivovarov shared on August 13, 2020. Speaking about Open Russia activist Yana Antonova’s nomination to the Krasnodar City Duma, Korovainy wrote that her campaign would require at least 200,000 rubles (about $2,725) in funding, and described how to make a donation. Antonova told the Russian BBC that “no one from the Investigative Committee or any other structures” had contacted her in connection with Pivovarov’s arrest.
Andrey Pivovarov was detained four days after Open Russia (Otkrytaya Rossiya) announced its dissolution. On May 27, Pivovarov said that the NGO, which is linked to exiled former oil company executive Mikhail Khodorkovsky, was completely halting its operations, in order to protect its supporters from criminal prosecution. Pivovarov added that the decision to dissolve Open Russia voluntarily was linked to the amendments to the law on “undesirable organizations” that were submitted to the Russian State Duma earlier last month. That said, the Russia-based nonprofit Open Russia isn’t formally designated as “undesirable.” The pressure on its activists apparently stem from the fact that this status was handed down to two other organizations linked to Khodorkovsky, the Open Russian Civic Movement and OR (Otkrytaya Rossia).
Mikhail Khodorkovsky compared Pivovarov’s arrest to the Belarusian authorities forcing the landing of a Ryanair passenger plane in Minsk and subsequently arresting opposition journalist Roman Protasevich and his girlfriend, Russian citizen Sofia Sapega. “Are there still doubts that Putin and Luka [Alexander Lukashenko] are two of a kind?” Khodorkovsky wrote on his Telegram channel on May 31. In turn, Tatyana Usmanova, the former coordinator of Open Russia, called the fact that Pivovarov was arrested for cooperating with an “undesirable organization” after Open Russia was dissolved “complete absurdity and lawlessness.”

Zitat: “Mit heute veröffentlichtem Beschluss hat der Erste Senat des Bundesverfassungsgerichts Anträge auf Erlass einer einstweiligen Anordnung abgelehnt, mit denen erreicht werden sollte, dass die in § 28b Abs. 1 Satz 1 Nr. 2 IfSG geregelte nächtliche Ausgangsbeschränkung vorläufig außer Vollzug gesetzt wird. Damit ist nicht entschieden, dass die Ausgangsbeschränkung mit dem Grundgesetz vereinbar ist. Eine solche Entscheidung kann das Bundesverfassungsgericht im Eilverfahren nicht treffen. Diese Prüfung bleibt den Hauptsacheverfahren vorbehalten.
Sachverhalt:
Durch das Vierte Gesetz zum Schutz der Bevölkerung bei einer epidemischen Lage von nationaler Tragweite wurde unter anderem eine Regelung über nächtliche Ausgangsbeschränkungen in das Infektionsschutzgesetz eingefügt. Überschreitet in einem Landkreis oder einer kreisfreien Stadt an drei aufeinander folgenden Tagen die durch das Robert-Koch-Institut veröffentlichte Anzahl der Neuinfektionen mit dem Coronavirus SARS-CoV-2 je 100.000 Einwohner innerhalb von sieben Tagen (Sieben-Tage-Inzidenz) den Schwellenwert von 100, so gelten dort ab dem übernächsten Tag die in § 28b Abs. 1 IfSG genannten Maßnahmen. So ist unter anderem nach § 28b Abs. 1 Satz 1 Nr. 2 IfSG der Aufenthalt von Personen außerhalb einer Wohnung oder einer Unterkunft von 22 Uhr bis 5 Uhr des Folgetages untersagt. Die Regelung enthält verschiedene Ausnahmetatbestände. Aufenthalte zwischen 22 und 24 Uhr, die der im Freien stattfindenden allein ausgeübten körperlichen Bewegung dienen, sind beispielsweise ebenso ausgenommen wie Aufenthalte, die der Abwendung eines medizinischen oder veterinärmedizinischen Notfalls, der Berufsausübung, der Wahrnehmung des Sorge- oder Umgangsrechts oder ähnlichen gewichtigen Zwecken dienen.
Die Beschwerdeführenden machen im Wesentlichen geltend, dass durch die bußgeldbewehrte Regelung von Ausgangsbeschränkungen in § 28b Abs. 1 Satz 1 Nr. 2 IfSG erhebliche Eingriffe in ihre Grundrechte erfolgten, die verfassungsrechtlich nicht gerechtfertigt seien. Sie begehren die vorläufige Außerkraftsetzung der gesetzlichen Vorschrift.
Wesentliche Erwägungen des Senats:
Die Anträge auf Erlass einer einstweiligen Anordnung haben keinen Erfolg.
I. Bei der Entscheidung über den Antrag auf einstweilige Anordnung haben die Gründe, die für die Verfassungswidrigkeit der angegriffenen Maßnahmen vorgetragen werden, grundsätzlich außer Betracht zu bleiben, es sei denn, der in der Hauptsache gestellte Antrag erwiese sich als von vornherein unzulässig oder offensichtlich unbegründet. Bei offenem Ausgang des Hauptsacheverfahrens muss das Bundesverfassungsgericht eine Folgenabwägung vornehmen. Wird die Aussetzung des Vollzugs eines Gesetzes begehrt, gelten dafür besonders hohe Hürden, weil dies einen erheblichen Eingriff in die originäre Zuständigkeit des Gesetzgebers darstellt. Die für eine vorläufige Regelung sprechenden Gründe müssen so schwer wiegen, dass sie den Erlass einer einstweiligen Anordnung unabdingbar machen und in diesem Fall darüber hinaus besonderes Gewicht haben.
II. Die zugrunde liegenden Verfassungsbeschwerden sind zwar weder von vornherein unzulässig noch offensichtlich unbegründet. Insbesondere sind die Beschwerdeführenden vorliegend nicht aus Gründen der Subsidiarität gehalten, vorab fachgerichtlichen Rechtsschutz in Anspruch zu nehmen. Die Verfassungsbeschwerden erweisen sich aber auch nicht schon als offensichtlich begründet. Der Ausgang des Hauptsacheverfahrens ist vielmehr offen.
1. Der Umstand, dass der Bundesrat dem Gesetz nicht zugestimmt hat, macht das Gesetz nicht offensichtlich formell verfassungswidrig. Die Notwendigkeit einer Zustimmung des Bundesrates für das Zustandekommen des genannten Gesetzes liegt jedenfalls nicht auf der Hand, sondern wirft Fragen auf, die näherer Klärung bedürfen.
2. Die Ausgangsbeschränkung nach § 28b Abs. 1 Satz 1 Nr. 2 IfSG ist auch nicht offensichtlich materiell verfassungswidrig. Es liegt nicht eindeutig und unzweifelhaft auf der Hand, dass sie zur Bekämpfung der Pandemie unter Berücksichtigung des Einschätzungsspielraums des demokratischen Gesetzgebers offensichtlich nicht geeignet, nicht erforderlich oder unangemessen wäre.
a) Die Ausgangsbeschränkung dient einem grundsätzlich legitimen Zweck. Der Gesetzgeber verfolgt in Erfüllung seiner verfassungsrechtlichen Schutzpflicht das Ziel, Leben und Gesundheit zu schützen, sowie die Funktionsfähigkeit des Gesundheitssystems als überragend gewichtigem Gemeingut und damit zugleich die bestmögliche Krankheitsversorgung sicherzustellen. Dieses Ziel soll durch effektive Maßnahmen zur Reduzierung von zwischenmenschlichen Kontakten erreicht werden.
b) Der Gesetzgeber betrachtet die Beschränkung des Aufenthalts im öffentlichen Raum als ein Mittel, um bisher in den Abendstunden stattfindende private Zusammenkünfte auch im privaten Raum zu begrenzen. Der vom Gesetzgeber erwartete Effekt, dass die Ausdehnung privater Zusammenkünfte durch die Ausgangsbeschränkung reduziert wird, ist jedenfalls nicht offensichtlich unplausibel. Es kommt hinzu, dass sich die Einhaltung der flankierenden Ausgangsbeschränkung grundrechtsschonender kontrollieren lässt als die Beschränkung privater Zusammenkünfte in privaten Räumen an sich. Ob die nächtliche Ausgangsbeschränkung geeignet ist, um ihr Ziel zu erreichen, ist fachwissenschaftlich umstritten. Ihre fehlende Eignung ist nicht evident. Der Gesetzgeber verfügt in der Beurteilung, ob die gesetzliche Regelung geeignet ist, um ihr Ziel zu erreichen, über eine Einschätzungsprärogative, die sich sowohl auf die Einschätzung und Bewertung der tatsächlichen Verhältnisse erstreckt als auch auf die etwa erforderliche Prognose und die Wahl der Mittel, um seine Ziele zu erreichen. Auch in der Beurteilung der Erforderlichkeit der Regelung kommt ihm ein Spielraum zu. Andere Mittel, die eine effektive Kontrolle vorhandener Kontaktbeschränkungen und darüber eine Reduktion der Ansteckungsrate ebenso wirksam gewährleisteten, aber weniger intensiv in Grundrechte eingriffen, liegen nicht offensichtlich auf der Hand.
c) Eine offensichtliche Unangemessenheit solcher Ausgangsbeschränkungen kann ebenfalls nicht erkannt werden. In den Hauptsacheverfahren über die Verfassungsbeschwerden wird die Verhältnismäßigkeit der hier angegriffenen gesetzlichen Regelung über die Ausgangsbeschränkung eingehender Prüfung bedürfen.
d) Die Ausgangsbeschränkung ist auch nicht deshalb offensichtlich ungeeignet, weil ihre Geltung an eine auf Landkreise und kreisfreie Städte bezogene Sieben-Tage-Inzidenz gebunden ist. Der Gesetzgeber sieht die Sieben-Tage-Inzidenz ohne klar ersichtliches Überschreiten seiner Einschätzungsprärogative als geeigneten Indikator für das Infektionsgeschehen an. Er geht davon aus, dass bei einer solchen Inzidenz eine Überlastung des Gesundheitswesens droht und die Eindämmung des Infektionsgeschehens durch Kontaktnachverfolgung endgültig nicht mehr möglich ist. Wegen der entsprechenden Erfahrungen in früheren Phasen der Pandemie hat das eine nachvollziehbare Grundlage.
III. Die deshalb nach den strengen Anforderungen an das vorläufige Außervollzugsetzen eines Gesetzes gebotene Folgenabwägung fällt zu Lasten der Beschwerdeführenden aus.
1. Erginge die einstweilige Anordnung nicht, erwiesen sich aber die Verfassungsbeschwerden später als begründet, sind die Nachteile aus der Fortgeltung der Ausgangsbeschränkung aus § 28b Abs. 1 Satz 1 Nr. 2 IfSG zwar von erheblichem Gewicht.
Die nächtliche Ausgangsbeschränkung greift tief in die Lebensverhältnisse ein. Die Folgen der Ausgangsbeschränkung wirken sich auf nahezu sämtliche Bereiche privater, familiärer und sozialer Kontakte ebenso wie auf die zeitliche Gestaltung der Arbeitszeiten aus. Eine besondere verfassungsrechtliche Herausforderung kann die angegriffene Ausgangsbeschränkung auch für Personen bedeuten, bei denen von einer Immunisierung gegen das Coronavirus SARS-CoV-2 auszugehen ist (§ 28c Satz 1 IfSG), wenn es so ist, dass sie für das Infektionsgeschehen nicht maßgeblich sind. Solchen Konsequenzen wirkt das Gesetz durch einen Teil der Ausnahmeregelungen entgegen, was die Folgen der Fortgeltung der Ausgangsbeschränkung abmildert. Die Einschränkungen privater Lebensgestaltung durch die Ausgangsbeschränkung außerhalb der Ausnahmetatbestände reichen dennoch weit. Die mit der Ausgangsbeschränkung unmittelbar oder mittelbar verbundenen Beschränkungen der Ausübung unterschiedlicher Freiheiten können von den Betroffenen nicht außerhalb des von der Beschränkung erfassten Zeitraumes oder nach dem Ende der Geltungsdauer der angegriffenen Regelung kompensiert werden. Bei der Beurteilung ist jedoch ebenso in den Blick zu nehmen, dass die Ausgangsbeschränkung in einen Zeitraum fällt, in dem nach den bisherigen Verhaltensmustern Aktivitäten außerhalb einer Wohnung oder Unterkunft keine ganz erhebliche quantitative Bedeutung haben. Sie betrifft den Zeitraum von 22 Uhr bis 5 Uhr und lässt körperliche Bewegung im öffentlichen Raum noch bis 24 Uhr zu. Weiterhin ist zu bedenken, dass deren Geltung an den Schwellenwert der Sieben-Tage-Inzidenz von 100 gekoppelt ist. Greifen die Maßnahmen zum Schutz vor der Ansteckung mit dem Virus und liegen die Voraussetzungen nach § 28b Abs. 2 Satz 1 IfSG vor, treten die Ausgangsbeschränkung ebenso wie die weiteren Schutzmaßnahmen aus § 28b Abs. 1 IfSG außer Kraft. Nach der für die Entscheidung über die Anträge auf Erlass einstweiliger Anordnungen maßgeblichen derzeitigen Rechtslage ist zudem die Geltungsdauer bis längstens zum 30. Juni 2021 begrenzt.
2. Würde § 28b Abs. 1 Satz 1 Nr. 2 IfSG durch einstweilige Anordnung vorläufig außer Vollzug gesetzt, erwiese sich die Regelung aber später als verfassungsgemäß, entfiele jedoch die Ausgangsbeschränkung als bundeseinheitlich wirkende Maßnahme der Infektionsbekämpfung, was ebenfalls Nachteile von erheblichem Gewicht verursachen könnte. Damit stünde ein für die gesetzgeberische Gesamtkonzeption der Maßnahmen zur Infektionsbekämpfung bedeutsames Instrument nicht mehr zur Verfügung. Die Ausgangsbeschränkung dient der Kontrolle der vorhandenen allgemeinen Kontaktregelungen und soll die Bereitschaft zu deren Einhaltung fördern. Dem kommt angesichts der nach wie vor absolut und relativ hohen Zahl von nachgewiesenen Neuinfektionen, der derzeit als gefährlich bewerteten Virusvarianten, den schweren Krankheitsverläufen und den Todesfällen erhebliche Bedeutung zu. Wirksame Maßnahmen zur Eindämmung der Pandemie erscheinen auch deshalb notwendig, weil die Auswirkungen hoher Infektionszahlen auf die Erfolge der derzeit stattfindenden Impfungen zu berücksichtigen sind. Nach den insoweit ebenfalls nachvollziehbaren Annahmen des Gesetzgebers kann eine zu große Zahl von Infizierten bei Kontakten mit noch nicht vollständig geimpften Personen die Entstehung von Virusvarianten mit verursachen, gegen die die vorhandenen und bereits verabreichten Impfstoffe weniger gut wirken. Dem Wegfall von einheitlich geltenden und wirkenden Ausgangsbeschränkungen als Mittel zur Sicherung bestehender Kontaktbeschränkungen kommt auch insoweit erhebliche Bedeutung zu.
3. Trotz der nicht unerheblichen Belastungen für sämtliche von der Ausgangsbeschränkung Betroffenen überwiegen die damit verbundenen Nachteile nicht gegenüber denen einer Außervollzugsetzung. Zwar kann die während der Ausgangsbeschränkung nicht ausübbare Freiheitsbetätigung nicht nachgeholt werden und es wird auch verstärkten physischen und psychischen Belastungen der Infektionsschutzmaßnahmen nur mit erheblichem Aufwand entgegengewirkt werden können. Stünde aber bis zu einer Entscheidung in der Hauptsache die bundeseinheitliche Ausgangsbeschränkung als Instrument zur Sicherung und Kontrolle der aktuell dringend gebotenen Kontaktbeschränkungen nicht zur Verfügung, gingen damit erhebliche, wenn auch im Einzelnen nicht sicher prognostizierbare Infektionsrisiken einher. Da der Gesetzgeber die Wirkungen der mit der Ausgangsbeschränkung verbundenen Freiheitsbeeinträchtigungen zudem über Ausnahmetatbestände abgemildert hat und die Geltungsdauer der angegriffenen Regelung nach derzeitiger Rechtslage zeitlich relativ eng begrenzt ist, überwiegen die Nachteile für die Betroffenen ungeachtet der erheblichen Eingriffsintensität der Ausgangsbeschränkung nicht gegenüber den Nachteilen für einen wirksamen Infektionsschutz bei Aussetzen der Regelung.”

Despite limited backing from civil society or public health experts, as well as warnings from historians and bioethicists, technologists are racing ahead to build and deploy digital certificates that would allegedly let individuals “prove” whether they have recovered from the novel coronavirus disease (COVID-19), have tested positive for antibodies, or have received a vaccination, should one become available. One such initiative is based on a combination of an emerging W3C standard for Verifiable Credentials (VCs), non-standard decentralized identifiers (DIDs), and distributed ledger technology (DLT) or “blockchain.”¹
In this article, we examine why such proposed technological interventions lack sufficient supporting scientific and public health evidence or legitimacy. As a result, we believe such interventions, if adopted or implemented by public authorities, would pose an unjustified interference with, and serious threat to, our fundamental human rights and civil liberties, in violation of the principles of legality, necessity, and proportionality. In this article, we outline our concerns from a legal, public health-based, and technical perspective.

Dem Urteil des Amtsgerichts Weimar vom 11. Januar 2021, Aktenzeichen 6OWi-523 Js 202518/20, war eine Geburtstagsfeier im April 2020 vorausgegangen, die von der Polizei beendet worden war. Sie sah darin einen Verstoß gegen die „Thüringer Verordnung über erforderliche Maßnahmen zur Eindämmung der Ausbreitung des Corona-Virus SARS-CoV-2“ und verhängte Bußgeldbescheide. Das heißt: Facebook Messenger, Gmail & Co sollen jede Kommunikation auf verdächtiges Text- und Bildmaterial scannen. Und zwar vollautomatisiert, durch den Einsatz von sog. ‘Künstlicher Intelligenz’ – ohne, dass ein Verdacht vorliegen muss. Meldet ein Algorithmus einen Verdachtsfall, werden alle Nachrichteninhalte und Kontaktdaten automatisch und ohne menschliche Prüfung an eine private Verteilstelle und weiter an Polizeibehörden weltweit geleitet. Die Betroffenen sollen nie davon erfahren.
Einige US-Dienste wie GMail und Outlook.com praktizieren diese automatische Nachrichten- und Chatkontrolle bereits. Verschlüsselte Nachrichten sind zurzeit noch ausgenommen. Die EU-Kommission will mit einem zweiten Gesetz aber bald alle Anbieter zum Einsatz dieser Technologie verpflichten”, so Patrick Breyer, EU-Abgeordneter von der Piratenpartei.

A federal judge on Thursday ordered the release of an independent monitor’s review of HSBC’s internal cleanup after a landmark $1.92 billion settlement for laundering drug money and for sanctions violations.
The U.S. Justice Department and the bank had claimed that disclosing the report could harm law enforcement efforts and provide criminals with a “road map” to holes in HSBC’s defenses against money laundering.
But U.S. District Judge John Gleeson ruled that the court and the public had a right to know whether HSBC was living up to its agreement to improve internal controls and merited a deferral of prosecution by the government.
“I care a great deal about the results of the monitor’s investigation,” Gleeson wrote. “[M]y review of those results is necessary to do my job properly.”
“If, for example, the monitor’s report disclosed that HSBC were systematically and extensively laundering money for drug traffickers, it would demean this institution for me to sit by quietly while the government took no action.”
Gleeson also said it was “equally appropriate and desirable for the public to be interested and informed now in the progress” of the HSBC settlement.
HSBC in 2012 reached a landmark settlement with the federal government, admitting that it had deliberately laundered funds for drug cartels and countries under trade sanctions. Prosecutors described the settlement as a “sword of Damocles” hanging over HSBC. Should the bank fail to improve, it would face prosecution for unbridled financial wrongdoing.
A condition of the settlement was that the bank submit to extensive outside review of its reform efforts. The former New York State ethics chief Michael G. Cherkasky was appointed as the HSBC monitor in 2013.
A leaked copy of his report recounted instances of U.S. bank managers bullying and shouting at compliance team members, and drew attention to the bank’s dealings with clients that had possible links to terrorism, according to Bloomberg.
Both Cherkasky and a spokesman for the Justice Department declined to comment. However in court papers Cherkasky had been quoted as saying that foreign government officials had only agreed to speak with him as part of his monitoring on condition that their communications remain confidential.
HSBC told 100Reporters that both British and American authorities had argued against releasing the report, citing the terms of the 2012 settlement.
“We therefore regret this decision and are considering our next steps,” said Rob Sherman, a spokesman for the bank.
White Collar Impunity
The HSBC settlement sits at the center of public outrage at perceived leniency in the federal government’s white-collar criminal law enforcement.
Under the terms of a so-called “deferred prosecution agreement,” the Justice Department will drop all charges — leaving HSBC with no conviction or criminal record — if after a five-year period prosecutors believe the bank has sufficiently cleaned up its act.
Since the early 1990s, such settlements have become a preferred tool for policing the corporate world and similar methods have recently been introduced in the United Kingdom. Prosecutors have defended them, saying they encourage cooperation and reform by targeted companies.
However, lawmakers and critics have denounced deferred prosecution agreements as symbols of white-collar impunity, reducing penalties for corporate crime to nothing more than the cost of doing business while less powerful defendants end up behind bars for lesser crimes.
Outside monitoring by independent experts, who often are awarded highly lucrative contracts to inspect companies’ performance and report back to prosecutors, have been a key feature of such settlements.
However, their reporting has been closely held and previous efforts to pry them loose from courts and the federal government have failed.
A federal appeals court in 2013 refused to allow the release of outside monitoring reports for the insurance giant American International Group Inc., which was bailed out with public funds during the global financial crisis.
Its outside monitor, James M. Cole, — who recently stepped down as the Justice Department’s No. 2 official — produced the reports as AIG was building the very derivatives portfolio that caused its liquidity crisis — a central element in the ensuing economic meltdown. The reports had been sought by the business reporter Sue Reisinger.
(100Reporters is currently also suing the Justice Department under the Freedom of Information Act for access to outside monitoring reports on anti-corruption compliance at Siemens, the German engineering colossus which pleaded guilty in 2008 to systematic bribery across the globe.)
Key to the decision in the AIG case was whether the reports were “judicial records” to which the public is entitled.
Federal appeals judges in Washington found that no judge had based any decision on the requested records and so they were not judicial records and could not be released.
But in his ruling handed down in Brooklyn on Thursday, Gleeson said that the HSBC case remained a matter before him and that the court would oversee any future prosecution of HSBC, based in no small part on the Cherkasky report — meaning the review was a judicial record.
Gleeson gave the Justice Department and HSBC until February 12 to submit proposed redactions after which he said he would release the “majority” of the report.
Gleeson’s decision was prompted by a seemingly obscure source — a November letter from a Pennsylvania man Hubert Dean Moore, who asked to review the report for a complaint against the bank that he had lodged with the Consumer Financial Protection Bureau.
Moore had sought a loan modification from the bank but believed that without the Cherkasky report, “my complaint is essentially a ‘he-said-she-said’ argument.”
Moore told The New York Post that he was “extremely happy” with Gleeson’s decision.
Brandon L. Garrett, a professor of law at the University of Virginia who analyzes corporate settlements, said Gleeson had struck a blow for transparency in the annals of white-collar criminal law.
“So much of what these monitors do remains totally out of the public eye. We do not even know who the monitors are in some of these prosecution agreements,” Garrett wrote in an email.
“We have no idea when these prosecutions quietly end whether the company actually complied. It is only because of Judge Gleeson’s supervision that the public knows so much about the apparently slow progress HSBC has made towards compliance.”

Der Racketeer Influenced and Corrupt Organizations Act (kurz RICO oder RICO Act) ist ein am 15. Oktober 1970 erlassenes Bundesgesetz der Vereinigten Staaten von Amerika.
Das Bundesgesetz „18 U.S.C. §§ 1961-1968“[1] wendete sich ursprünglich vor allem gegen das „Racketeering“ der amerikanischen Mafia („La Cosa Nostra“) und gegen die Vorgänge innerhalb der Gewerkschaften, insbesondere der Transportgewerkschaft der Teamsters. Es ist eine Rechtsgrundlage zur Bekämpfung und Verurteilung von kriminellen Aktivitäten von Mobstern und kriminellen Vereinigungen des organisierten Verbrechens.
Die Möglichkeiten der Strafvergabe für Drogenhandel waren am 1. Juli 1957 bereits durch den „Narcotic Control Act“ ausgeweitet und zu einem Bundesvergehen erklärt worden. Der RICO Act ermöglicht es Bundesanwälten darüber hinaus, Klage zu erheben, wenn eine Person in Verdacht steht, einer kriminellen Organisation anzugehören. Dies kann der Fall sein, wenn der Angeklagte innerhalb von zehn Jahren zwei von insgesamt 35 definierten Straftaten mit demselben Ziel oder Resultat begangen hat. Zunächst nur wenig, wurde die Regelung dann in den 1980er Jahren in zunehmendem Maße angewendet.
Aus deutscher Sicht bemerkenswert ist die Möglichkeit, Kriminalität nicht nur durch drastische strafrechtliche Mittel, sondern auch durch zivilrechtliche Klagemöglichkeiten und umfangreiche Schadenersatzansprüche für geschädigte Dritte zu verfolgen.
1979 wurde das Gesetz gegen Ralph „Sonny“ Barger angewendet, um insbesondere den Drogen- und Waffenhandel der Fraktion der Hells Angels in Oakland zu unterbinden. Allerdings kam es damals zu einem Freispruch.[2]
Frank Tieri war am 21. November 1980 der erste Cosa-Nostra-Boss, der auf Grundlage des RICO Acts angeklagt und am 23. Januar 1981 zu zehn Jahren Haft verurteilt wurde.
1987 wurde Anthony Salerno, ein weiterer Boss der Genovese-Familie, vor einen „Mafia Commission Trial“ geladen, der auf Grund des RICO Acts einberufen werden konnte. Dort wurde die Korruption zwischen Mafia und Gewerkschaft behandelt und Salerno wurde zu insgesamt 100 Jahren Haft verurteilt. Außerdem erreichte im September 1987 Rudolph Giuliani eine Verurteilung eines Großteils der Mitglieder der irischstämmigen Westies, die Assoziierte der Gambino-Familie waren. Allein der Anführer James „Jimmy“ Coonan erhielt eine Freiheitsstrafe von 60 Jahren.
1989 wurde der amerikanische Finanzier und Investmentbanker Michael Milken, der als Symbol der Gier an der Wall Street während der 1980er Jahre gilt, des Finanzbetruges angeklagt, bekannte sich in fünf Punkten für schuldig und wurde zu 10 Jahren Haft verurteilt, jedoch nach 22 Monaten Gefängnis im Januar 1993 entlassen.
1999 bis 2007 diente der RICO Act als Grundlage einer Klage der US-Regierung gegen die US-Tabakindustrie. Der aktuelle Prozessstand wird auf tobacco-on-trial (englisch)[3] oder von Philip Morris USA (englisch)[4] sowie als Zusammenfassung (deutsch)[5] dokumentiert.
Zwischen dem 14. Februar und 15. Mai 2000 musste sich James Marcello zusammen mit Anthony Zizzo einem Prozess stellen. Die Anklage lautete auf Verschwörung, illegales Glücksspiel und Mord.[6] Marcello wurde zu 12, Zizzo zu 10 Jahren Haft verurteilt. Marcello wurde jedoch im November 2003[7] aus der Haft entlassen und nahm offensichtlich seine Tätigkeit für das Chicago Outfit wieder auf, als dessen aktueller Boss er nach Auffassung des FBI anzusehen ist.
Im März 2006 wurde Barry Mills, Anführer der „Aryan Brotherhood“, auf RICO-Grundlage angeklagt und zu einer lebenslagen Haftstrafe verurteilt.[8]
Im Jahr 2007 wurde eine Sammelklage gegen Microsoft und das Handelsunternehmen Best Buy in einem Berufungsverfahren vor dem United States Court of Appeals for the Ninth Circuit in San Francisco – trotz Bedenken – auf Grundlage des RICO Act zugelassen. Die Klage hatte im April 2000 James Odom angestrengt, der beiden Firmen Betrug vorwarf, da sie bei Käufen über Kreditkarten Kundeninformationen austauschten und der Kunde darüber nicht informiert werde. Microsoft hatte sich nach einer Investition von 200 Millionen US-Dollar in Best Buy verpflichtet, Werbung für diese Firma zu machen, im Gegenzug sollte der Händler Produkte von Microsoft bewerben.[9]
Im Januar 2008 erhob Star Energy eine Klage auf RICO-Act-Grundlage gegen RSM Top Audit (Moskau), RSM International (London) sowie einzelne Vertreter der Buchprüfungsfirmen und andere Einzelpersonen. „Star unterstellt ein Muster krimineller Geschäfte, das auf die Finanzmärkte der Vereinigten Staaten abzielt.“[10] Demnach soll RSM, eine der sieben größten internationalen Wirtschaftsprüfungsorganisationen weltweit, Buchprüfungen russischer Unternehmen fälschen, damit diese an den Kapitalmärkten der Vereinigten Staaten von Amerika Kapital aufnehmen können. Das Verfahren ist noch nicht entschieden.
Am 19. Juli 2010 wurde gemeldet, dass Anwälte von Geschädigten der Katastrophe der Deepwater Horizon in den USA mindestens drei Klagen gegen BP unter dem RICO Act eingereicht haben. Derzeit prüft das US-Justizministerium, ob der RICO Act in diesem Fall zur Anwendung kommt.[11]
Im Zuge der Ermittlungen wegen Korruptionsvorwürfen 2015 wurde bekannt, dass die US-Strafverfolgungsbehörden den internationalen Fußballverband FIFA als korrupte Organisation im Sinne des RICO Act betrachten.[12]
