Participation and aiding and abetting in the activities of an organized criminal community established with the purpose of systematically committing particularly dangerous crimes directed against the foundations of the constitutional system and state security, state power and interests of state service, justice, as well as against peace and security.
According to open sources, Nurgaliyev is suspected of using his official position contrary to the interests of the state while holding a number of positions in the security services. He allegedly performed his duties improperly, resulting in damage to civil rights and freedoms, and committed acts in excess of his official authority, resulting in significant violations of the legally protected interests of society.
Responsible for a number of MIA misconducts, which included beatings and murders.
Possible violations of the law
Rashid Nurgaliyev’s actions may contain indications of the following crimes under the Criminal Code of the Russian Federation:
- Art. 210 of the RF Criminal Code “Organization of a criminal community (criminal organization) or participation in it (it),” that is, participation in the activities of a criminal community established for the purpose of forcibly and illegally keeping power contrary to the requirements of the RF Constitution and systematically committing other crimes against power, justice, interests of service and peace.
- Art. 286 of the Criminal Code of the RF “Exceeding official powers”, i.e. committing by an official of actions clearly going beyond his authority and resulting in a significant violation of the rights and legitimate interests of citizens, as well as the legitimate interests of society and the state.
- Art. 353 of the Criminal Code “Planning, preparation, unleashing and waging a war of aggression,” including the implementation of aggression against Ukraine, as well as the unjustified use of the armed forces of the Russian Federation on the territory of other states.
- Art. 208 of the Criminal Code of the Russian Federation. “Organization of or participation in an illegal armed formation”, i.e. Establishment of an armed formation (association, detachment, druzhina or other group) not provided for by federal law, as well as leadership of such a formation or its financing.
