Why in the List
Participation and abetting in the activities of the organized criminal community, created for the purpose of systematic commission of especially dangerous crimes, directed against the foundations of the constitutional system and state security, state power and interests of state service, justice, as well as against peace and security.
According to the Znak and Regnum publications, the Russian health minister was involved in the “case of the tomographs. The criminal case was initiated in 2011 when Mikhail Murashko was the Minister of Health of the Komi Republic. According to Znak, in 2009, the Komi Republic purchased four CT scanners, amounting to 197.8 million rubles appropriated from the federal budget. According to investigators, 15.9 million rubles were stolen from that amount. Sergei Konchitsa, former head of the Main department of material and technical support of health care of the republic, was charged in the case of negligence for insufficient control over the procurement. Murashko was a witness in the case, and he appeared in court only after being coerced. The criminal case was closed in 2012 for lack of grounds for prosecution.
According to the publication Tribuna, after Murashko took over as head of Roszdravnadzor, Dmitry Berezin, with whom the current minister had studied together, took over as minister of health in Komi. In 2018, Murashko’s former deputy, Yevgeniya Kotova, took over as general director of the federal autonomous institution National Institute for Accreditation. According to the publication Tribuna, Murashko may have facilitated this appointment.
Possible violations of the law
The actions of Mikhail Albertovich Murashko may contain elements of the following crimes under the Criminal Code of the Russian Federation:
- Art. 210 of the Criminal Code of the Russian Federation “Organization of a criminal community (criminal organization) or participation in it (it)”, i.e. participation in the activities of a criminal community established for the purpose of violent illegal retention of power contrary to the requirements of the Russian Constitution, and the systematic commission of other crimes against the government, justice, interests of service and peace.
- Art. 285 of the Criminal Code of the RF “Abuse of Office” – the use by an official of his official powers contrary to the interests of service and with mercenary or other personal interest.
- Art. 293 of the Criminal Code “Negligence”, i.e. non-performance or improper performance by an official of his/her duties due to dishonest or negligent attitude to service or duties in office, if it caused major damage or substantial violation of rights and legitimate interests of citizens or organizations or legally protected interests of society or the state.
