Participation and aiding and abetting in the activities of an organized criminal community established with the purpose of systematically committing particularly dangerous crimes against the foundations of the constitutional order and state security, state power and interests of state service, justice, as well as against peace and security.

According to the BBC, Maksut Shadaev’s half-brother Sergei Kholkin has been head of the “Pharma” department at the Center for the Development of Advanced Technologies (CDAP) since July 2019. It is planned that the CDPT will deal with drug labeling, which will be mandatory from July 1, 2020. “Vedomosti” estimated that over the first seven years of the project CRPT will receive a profit of 10.5 billion rubles (1.5 billion per year). The BBC also notes that the Ministry of Communications, which is headed by Shadaev, is one of the key participants in this project.

From 2004 to 2008, Maxut Shadaev was in the team of former Information Technology and Communications Minister Leonid Reiman. Shadaev served as an adviser to the minister. In 2011, the General Prosecutor’s Office became interested in the “Electronic Russia” project, which was implemented from 2002 to 2010. According to Interfax, the Ministry of Communications and Rostelecom signed contracts worth 2 billion rubles, while the General Prosecutor’s Office discovered the embezzlement of 300 million rubles. Shadaev was summoned to the investigation department of the Ministry of Internal Affairs (he supervised the group that was engaged in the Electronic Russia project). As a result, the Interior Ministry found no corpus delicti in the case of Electronic Russia.

Possible Violations of Law
The actions of Shadaev Maksut Igorevich may contain elements of the following crimes under the Criminal Code:

  • Art. 210 of the Criminal Code of the Russian Federation “Organization of a criminal community (criminal organization) or participation in it (it)”, i.e. participation in the activities of a criminal community established for the purpose of forcible illegal retention of power contrary to the requirements of the Russian Constitution, and systematic commission of other crimes against power, justice, interests of service and peace.
  • Art. 285 of the Criminal Code of the Russian Federation “Abuse of Office”, i.e. the use by an official of his official powers against the interests of the service and with selfish or other personal interest.
