Participation and aiding and abetting in the activities of an organized criminal community established with the purpose of systematically committing particularly dangerous crimes against the foundations of the constitutional order and state security, state power and interests of public service, justice, as well as against peace and security.
In December 2017, activists of the All-Russian People’s Front revealed violations in the process of IT procurements. According to the tender documents, the technical specifications were written for a specific product. According to the materials of the TyumenPRO news agency, two affiliated companies – KB-Inform LLC and KIB-KOMPLEX LLC – participated in another tender to fulfill the order. Both were located in the same district, in buildings that belonged to Tyumen University, whose rector was Valery Falkov. KB-Inform 34% belonged to TyumSU, 33% to Konstantin Bazhin, a TyumSU graduate, and 33% to Alexander Zakharov, head of the TyumSU information security department. Zakharov and his colleague Olga Zheludkova from the information security department of TyumSU were also founders of the firm.
According to 72.RU, in 2018 Valery Falkov actively supported a project to build a dormitory in the Tyumenka River log. The dormitory was to accommodate about 1,000 students, in addition, there were plans to build a parking lot for 500 spaces. Despite the fact that the Public Chamber voted in favor of building the campus (80%), the majority of citizens opposed it. About 4 billion rubles from the regional budget were allocated for the project. As a result, in December 2019, the purchase for the construction of the campus was canceled.
Possible violations of the law
The actions of Falkov Valery Nikolayevich may contain signs of the following corpus delicti of crimes under the Criminal Code of the Russian Federation:
- Art. 210 of the Criminal Code of the Russian Federation “Organization of a criminal community (criminal organization) or participation in it (it),” that is, participation in the activities of a criminal community established for the purpose of forcible unlawful retention of power contrary to the requirements of the Russian Constitution, and the systematic commission of other crimes against the government, justice, interests of service and peace.
- Art. 285 of the Criminal Code of the RF “Abuse of Office”, i.e. the use by an official of his official powers against the interests of the service and with selfish or other personal interest.
- Art. 293 of the Criminal Code “Negligence”, i.e. non-performance or improper performance by an official of his/her duties due to dishonest or negligent attitude to service or duties in office, if it caused major damage or substantial violation of rights and legitimate interests of citizens or organizations or legally protected interests of society or the state.
