Participation and abetting in the activities of the organized criminal community, established with the purpose of systematic commitment of especially dangerous crimes directed against the foundations of the constitutional system and state security, state power and interests of the state service, justice, as well as against peace and security.

According to open sources, Alexander Nikolaevich Tkachev is suspected of covering up the crimes committed by the Tsapkovskaya Organized Crime Group in the village of Kushchevskaya in Krasnodar territory.

Presumably, he was responsible for misappropriation of budgetary funds for personal needs. According to media reports, in 2003, a delegation of officials from the Krasnodar Territory purchased a PZL W-3 Sokół helicopter in Poland. All expenses, including transportation of the helicopter, were paid from the state budget. In 2013, Tkachev ordered the purchase of a Eurocopter EC 145 helicopter and training pilots to evacuate the victims, and the customer specified the parameters of the interior of the helicopter, corresponding to private aircraft. According to the information on the public procurement website, the total cost of the project amounted to 11 million euros.

On the basis of publications in the media, he is suspected of carrying out entrepreneurial activities, contrary to the prohibition established by law, while serving as Minister of Agriculture. In 2016, it became known that the company “Parus”, which owns about 100 thousand hectares of land in the Krasnodar Territory, as well as warehouses for grain storage with a capacity of over 150 thousand tons, is owned by an offshore “Palmway Holdings Limited” from the British Virgin Islands, whose beneficiary is Alexander Tkachev.

According to the Russian media, he is suspected of having used his official position for personal gain, in particular by giving preferential treatment to business structures owned by his relatives and friends, while occupying top government positions.

Based on the information in the media, it can be assumed that the actions of Alexander Nikolaevich Tkachev are indicative of unjust enrichment and a violation of the conflict of interests. Tkachev owns real estate, the value of which several times exceeds his official income, and the former Minister of Agriculture has not been checked for possible non-payment of taxes. According to his income declaration for 2016, Tkachev owns real estate with a total area of 6,323 square meters, in addition, more than 10,600 square meters of land near Tuapse, Krasnodar region are in lease. According to the media, Alexander Tkachev was on the list of former owners of a 42-meter yacht Renegade worth 25 million dollars.

Possible violations of the law
The actions of Alexander Nikolaevich Tkachev may contain indications of the following crimes provided by the Criminal Code of the Russian Federation:

Art. 210 of the Criminal Code of the Russian Federation “Organization or participation in a criminal association (criminal organization)”, i.e. participation in the activities of a criminal association established for the purpose of illegal forcible retention of power contrary to the requirements of the Russian Constitution, and systematic commission of other crimes against the government, justice, interests of service and peace.
Art. 316 of the Criminal Code “Concealment of Crimes”, i.e. the concealment of especially grave crimes, which was not promised in advance.
Art. 285.1 of the Criminal Code of the RF “Misappropriation of budget funds”, i.e. the expenditure of budget funds by an official of the recipient of budget funds for purposes not corresponding to the conditions of their receipt, determined by the approved budget, budget schedule, notice of budget allocations, estimate of income and expenses or other document which is the basis for receipt of budget funds, committed in a large amount.
Art. 289 of the Criminal Code of the RF “Illegal participation in entrepreneurial activities,” that is, the establishment by an official of an organization engaged in entrepreneurial activities, or participation in the management of such an organization personally or through a proxy, contrary to the prohibition established by law.
Art. 285 of the Criminal Code of the Russian Federation “Abuse of Office”, i.e. the use by an official of his official powers contrary to the interests of the service and with mercenary or other personal interest.
