EUGH: German prosecutors may no longer issue EU arrest warrant
The European Court of Justice (EUJ) recently ruled that public prosecutors in Germany are not authorized to issue European arrest warrants. The EUCJ judges justified the decision by saying that there was “no sufficient guarantee of (the) independence vis-ร -vis the executive.” Unlike in other European countries, in Germany there is authority to issue instructions to prosecutors by justice ministers.
