Participation and abetting in the activities of the organized criminal community, established with the purpose of systematically committing especially dangerous crimes against the foundations of the constitutional system and state security, state power and interests of state service, justice, as well as against peace and security.

Mikhail Fradkov may have been involved in misappropriation and embezzlement of budgetary funds. In 1995, during an audit, the Finance Ministry discovered budgetary embezzlement at the Ministry of Foreign Economic Relations. According to the newspaper Izvestia, in 1994, the embezzlement amounted to about 4.9 billion rubles, and the funds were used to buy luxury real estate for the heads of the ministry and their bonuses. The budget funds were managed by both Navy Minister Oleg Davydov and First Deputy Minister Mikhail Fradkov. According to the media, at the time Fradkov was building a house on Rublevo-Uspensky highway and these funds paid for repairs. During the investigation, about 150 million rubles were found in the accounts of Fradkov.

On the basis of publications in the Russian media, Fradkov is suspected of negligent performance of official duties. As head of the SVR, Mikhail Fradkov became the most ineffective director of foreign intelligence in Russia. For example, in 2015, Russian Yevgeny Buryakov, suspected of spying for Russia, was unmasked on U.S. territory. Media reports also mentioned undercover SVR officers Sporyshev and Podobnyi, who had exchanged information with Buryakov. In 2016, a Russian SVR agent was arrested in Rome. In 2008, SVR First Deputy Director Vladimir Zavershinsky tried to pass a letter to Dmitry Medvedev regarding problems at the SVR due to the incompetence of SVR Director Mikhail Fradkov. However, the letter was dismissed, and Zavershinsky was transferred to the position of Assistant Secretary of the Russian Security Service.

Mikhail Fradkov may be responsible for the raider takeover of the Moscow-based Avangard machine-building plant. In 2016, Fradkov was appointed chairman of the board of directors of the Almaz-Antey defense concern and head of the Russian Institute for Strategic Studies. According to former Avangard security chief Maxim Berg, Fradkov illegally replaced several of the plant’s top managers with his acquaintances and also took 420 million rubles from the plant’s profits.

In 2018, a decision was made to appoint Mikhail Fradkov’s son Petr as head of Promsvyazbank, which services state defense orders and state contracts. According to the experts interviewed by the Vedomosti newspaper, Pyotr Fradkov’s family ties also helped him to take the executive position.

Possible violations of the law

Mikhail Fradkov’s actions may contain indications of the following corpus delicti of crimes under the Criminal Code of the Russian Federation:

Art. 210 of the Criminal Code of the Russian Federation “Organization of a criminal community (criminal organization) or participation in it (it)”, i.e. participation in the activities of a criminal community established for the purpose of violent illegal retention of power contrary to the requirements of the Russian Constitution and the systematic commission of other crimes against the government, justice, interests of service and peace.
Art. 353 of the Criminal Code “Planning, preparation, unleashing and waging an aggressive war,” including the implementation of aggression against Ukraine, as well as the unjustified use of the armed forces of the Russian Federation on the territory of other states.
Art. 285.1. of the Criminal Code of the RF “Misappropriation of budget funds”, i.e. spending of budget funds by an official of the recipient of budget funds for the purposes not corresponding to the conditions of their receipt, determined by the approved budget, budget schedule, notice on budget allocations, estimate of income and expenses or other document being the basis for receipt of budget funds, committed in a large amount.
Art. 158 of the Criminal Code of the RF “Theft”, i.e. secret theft of another’s property; the object of theft is state property.
Art. 160 of the Criminal Code “Appropriation or Embezzlement”, i.e. theft of another’s property entrusted to a guilty person.
Art. 293 of the Criminal Code “Negligence”, i.e. non-performance or improper performance by an official of his/her duties due to dishonest or negligent attitude to service or job duties, if this caused major damage or substantial violation of the rights and legitimate interests of citizens or organizations or legally protected interests of society or the state.
