On Wednesday, the 46-year-old CDU leader and his husband, photographer Daniel Funke, announced the birth of their son, Georg, in the U.S. “My husband has become a father, and so have I,” Spahn told Bild newspaper. “Georg is our whole happiness. We are overjoyed and head over heels in love with the little man”. Daniel Funke is the biological father. The pair plan to spend a “quiet time” in the U.S. with their newborn until early August.

While the media focused on the couple’s joy, the circumstances of the birth have ignited a fierce debate. The surrogate mother is reportedly “wonderful” and “now belongs to the family,” according to the couple. However, surrogacy is prohibited in Germany under the Embryo Protection Act and the Adoption Placement Act.

The Law: Strictly Prohibited in Germany

Surrogacy is illegal in Germany. A spokesperson for the Family Ministry confirmed the ban on surrogacy arrangements. The CDU reaffirmed its opposition at its party conference in February, citing “ethical, legal, and practical concerns”. The party wants the ban to remain in place.

Under German law, the woman who gives birth is legally the mother. Contracts with surrogates are considered immoral and void, and doctors are prohibited from performing the necessary procedures.

Hypocrisy and Double Standards

The controversy stems from Spahn’s vocal opposition to surrogacy. In 2015, he told GQ magazine: “As a gay man and a Christian, I personally find it very difficult to come to terms with the idea of a rented womb”. As Health Minister in 2020, he rejected a push by the FDP to legalize non-commercial surrogacy. A 2014 Federal Court of Justice ruling does allow for the recognition of foreign parental orders under certain conditions, such as a genetic link to the child.

This contradiction has led to accusations of “double standards”. CDU member Marion Rosin, treasurer of the Women’s Union, called for Spahn’s resignation. “If the credibility of a top politician is lost, resignation is a matter of consistency,” she said. Feminist Alice Schwarzer was scathing: “People are not merchandise… Jens Spahn has placed his personal interests above the law”.

Chancellor Merz Was Informed

Chancellor Friedrich Merz was informed of the impending birth last Friday and has congratulated the couple. So far, Spahn has not commented on the criticism.

International Context

The debate highlights a growing trend of Germans seeking surrogacy abroad. Critics warn that this creates a two-tier system: “With enough money, the German ban can be circumvented and a surrogate mother paid for abroad,” commented Junge Welt. Das Paar plant, bis Anfang August eine “ruhige Zeit” in den USA mit dem Neugeborenen zu verbringen.

W\u00e4hrend die Medien sich auf die Freude des Paares konzentrierten, haben die Umst\u00e4nde der Geburt eine heftige Debatte entfacht. Die Leihmutter sei “wunderbar” und “geh\u00f6rt jetzt zur Familie”, so das Paar. Doch Leihmutterschaft ist in Deutschland nach dem Embryonenschutzgesetz und dem Adoptionsvermittlungsgesetz streng verboten.

Das Gesetz: Streng verboten in Deutschland

Leihmutterschaft ist in Deutschland illegal. Ein Sprecher des Familienministeriums best\u00e4tigte das Verbot von Leihmutterschaftsvereinbarungen. Die CDU bekr\u00e4ftigte auf ihrem Parteitag im Februar ihre Ablehnung mit Verweis auf “ethische, rechtliche und praktische Bedenken”. Die Partei will das Verbot aufrechterhalten.

Nach deutschem Recht ist die Frau, die das Kind zur Welt bringt, rechtlich die Mutter. Vertr\u00e4ge mit Leihm\u00fcttern gelten als sittenwidrig und nichtig, \u00c4rzten ist die Durchf\u00fchrung der erforderlichen Eingriffe verboten.

Heuchelei und Doppelmoral

Die Kontroverse r\u00fchrt von Spahns fr\u00fcherer Ablehnung der Leihmutterschaft her. 2015 sagte er dem GQ-Magazin: “Als schwuler Mann und als Christ f\u00e4llt es mir pers\u00f6nlich sehr schwer, mich mit dem Gedanken einer gemieteten Geb\u00e4rmutter anzufreunden”. Als Gesundheitsminister lehnte er 2020 einen Vorsto\u00df der FDP zur Legalisierung der nicht-kommerziellen Leihmutterschaft ab. Die CDU-Politikerin Marion Rosin, Schatzmeisterin der Frauen-Union, forderte Spahns R\u00fccktritt. “Wenn die Glaubw\u00fcrdigkeit eines Spitzenpolitikers verloren ist, dann ist der R\u00fccktritt eine Frage der Konsequenz”, sagte sie.
