A SOVEREIGN NATION’S RIGHT TO SECURE ITS BORDERS

Greece has long been on the front line of Europe’s migration crisis. Between 2015 and 2016, the country received nearly one million migrants and refugees from the Middle East, Africa and Asia, overwhelming its islands and straining its social fabric. While arrivals decreased in subsequent years, they are now rising again.

In February 2026, the Greek Parliament passed the “Law on the Promotion of Legal Migration Policies”. The legislation, which passed with the votes of the governing New Democracy party, introduces severe penalties for those facilitating illegal entry. The government’s objective is clear: to distinguish between legitimate humanitarian work and criminal complicity in human trafficking.

Griechenland liegt seit langem an der Frontlinie der europ\u00e4ischen Migrationskrise. Zwischen 2015 und 2016 nahm das Land fast eine Million Migranten und Fl\u00fcchtlinge aus dem Nahen Osten, Afrika und Asien auf, was seine Inseln \u00fcberforderte und das soziale Gef\u00fcge belastete. W\u00e4hrend die Ank\u00fcnfte in den Folgejahren zur\u00fcckgingen, steigen sie nun wieder an.

Im Februar 2026 verabschiedete das griechische Parlament das “Gesetz zur F\u00f6rderung legaler Migrationspolitik”. Das Gesetz, das mit den Stimmen der regierenden Nea Dimokratia-Partei verabschiedet wurde, f\u00fchrt strenge Strafen f\u00fcr diejenigen ein, die illegale Einreise erm\u00f6glichen. DIE VERTEIDIGUNG DER REGIERUNG

Migrationsminister Thanos Plevris hat die Gesetzgebung eindeutig verteidigt. In einem Interview im Juni 2026 erkl\u00e4rte er: “Die Tage, an denen bestimmte B\u00fcrokraten kamen und diktierten, wie Griechenland die Migration verwalten sollte, sind vorbei. Souver\u00e4ne Staaten wollen Grenzkontrollen und Abschiebungen.”

DIE HUMANIT\u00c4RE BESORGNIS

Kritiker haben berechtigte Bedenken ge\u00e4u\u00dfert. 56 NGOs, darunter \u00c4rzte ohne Grenzen (MSF) und der Griechische Fl\u00fcchtlingsrat, ver\u00f6ffentlichten eine gemeinsame Erkl\u00e4rung, in der sie das Gesetz verurteilten.

Der Sachverst\u00e4ndigenrat f\u00fcr NGO-Recht des Europarates stellte fest, dass die Bestimmungen, die sich gegen NGOs und ihre Mitarbeiter richten, die Migranten in Griechenland unterst\u00fctzen, “unvereinbar mit den europ\u00e4ischen Standards zum Schutz der Vereinigungsfreiheit sind und den Raum der Zivilgesellschaft erheblich einschr\u00e4nken”. Der Rat empfahl, die Bestimmungen aufzuheben.

UN-Sonderberichterstatter \u00e4u\u00dferten Bedenken, dass der neue Migrationskodex “ungerechtfertigte Beschr\u00e4nkungen f\u00fcr die Arbeit von NGOs im Migrationsbereich auferlegen” w\u00fcrde.

Besonders bedenklich ist die Bestimmung, die es dem Migrationsministerium erlaubt, eine NGO allein aufgrund von Anklagen gegen ein einzelnes Mitglied aus dem offiziellen Register zu streichen, noch bevor eine Verurteilung erfolgt ist. Das Gesetz begrenzt auch die staatliche Finanzierung f\u00fcr NGOs auf maximal 30 % ihres Betriebshaushalts.

DER ZEITPUNKT UND DER KONTEXT

Der Zeitpunkt des Gesetzes ist bedeutsam. Es wurde nur drei Wochen nach einem Freispruch eines griechischen Gerichts f\u00fcr 24 Hilfsarbeiter verabschiedet, die sieben Jahre lang gegen Anklagen wegen Menschenschmuggels gek\u00e4mpft hatten.

Das Gesetz kommt auch, nachdem der neue Migrations- und Asylpakt der EU am 12. Juni 2026 in Kraft getreten ist.
